I – Quelques
dates repères à propos de l’histoire de la firme LIONEL :
25/08/1877 : naissance de Joshua Lionel COHEN,
devenu Joshua Lionel COWEN en 1910 ;
Année 1900 :
fondation de la firme LIONEL MANUFACTURING COMPANY (LIONEL MFG COMPANY) à
New-York qui fabriquera des trains-jouets ;
Année 1902 :
sortie du premier catalogues de 16 pages ;
Année 1906 :
adoption de l’écartement dit « Standard » qui est de

19/12/ 1916 :

Année 1937 : la firme est la première aux USA, en termes de ventes, dans le

Années 1949-1953 : années de records pour la vente des trains-jouets LIONEL ;

démission de J. L COWEN et reprise de la firme par Roy COHN, un petit neveu,

08/09/1965 : décès de J. L COWEN ;
Après 1965 : la firme continue de produire, jusqu’à nos jours, soit 113 ans après
sa fondation ; différents propriétaires se sont succédés pendant cette

II – Bilan
à propos des brevets déposés par la firme LIONEL avant la seconde guerre
mondiale, entre les années 1900 et 1938 :
L’analyse de la littérature brevets fait ressortir,
sur la période allant de 1900 à 1938, l’existence d’environ 94 « brevets prioritaires » américains (US)
couvrant chacun un innovation technique en relation étroite avec le domaine des
trains-jouets. Le graphique suivant donne la production de brevets année par
année :
L’expression « brevets prioritaires »
signifie que, pour chaque invention, le premier dépôt a eu lieu aux Etats-Unis
(USA) en établissant chaque fois un droit de priorité qui permet au demandeur
en brevet de pouvoir étendre son invention dans d’autres pays en bénéficiant de
la date du dépôt d’origine aux USA.
Nombre
de brevets par inventeur
Aux USA, le droit au brevet appartient à l’inventeur, et à l’inventeur premier en
date, personne physique, qui a seul le droit de déposer une demande de brevet.
Le titre officiel délivré par « The United States Patent and Trademark Office »
comporte bien entendu le nom de l’inventeur et il peut mentionner en plus, à
coté du nom de l’inventeur, le nom du demandeur
(assignee) auquel l’inventeur a cédé ses droits (il peut s’agir d’une autre
personne physique cessionnaire ou d’une personne morale comme l’employeur de
l’inventeur).
Les noms des inventeurs ayant à leur actif au moins 5 brevets prioritaires US et les noms des demandeurs
concernés (en cas de cession des droits) des (environ) 94 brevets prioritaires US sont rassemblés dans le
tableau suivant où l’ordre croissant des inventeurs correspond à l’ordre
chronologique des périodes de création de ces derniers :
